Terms of Service

Please read these terms carefully before purchasing live plants, ordering supplies, or using our website. By accessing or purchasing from Bog & Bloom, you agree to be bound by these terms.

1. Business Overview

Bog & Bloom is operated by Black Creek, LLC. We specialize in curated, nursery-propagated carnivorous plants, propagation kits, and care accessories.

2. Live Plant Shipping & Weather Holds

Because we ship live, temperature-sensitive plants, we prioritize the health of the plant above all else.

  • We ship early in the week (typically Mondays and Tuesdays) to prevent plants from sitting in transit over weekends.
  • Weather Holds: If the forecast at our origin (Michigan) or your destination is below 35°F or above 95°F, we will place a temporary weather hold on your order and notify you. The order will ship as soon as temperatures stabilize.

3. Live Arrival Guarantee & Claims

We guarantee that our plants will arrive alive and healthy when shipped under suitable weather conditions.

  • Time Window: If a plant arrives severely damaged or dead, you must report it within 24 hours of delivery.
  • Required Evidence: All claims must be accompanied by clear, high-resolution photos of the plant, the soil surface, the packaging, and the shipping label.
  • Exclusions: We cannot guarantee the long-term survival of plants once they are in your care. Carnivorous plants have highly specific requirements (such as mineral-free water and bright light). We are not responsible for plant death caused by tap water, potting soil containing fertilizer, or lack of light.

4. Payments & Security

All payments are processed securely through Stripe. We do not store or have access to your raw credit card numbers. You agree to provide current, complete, and accurate purchase and account information for all purchases.

5. Reseller & Partner Pilots

Purchases made via our grocery store partner QR codes are subject to the same terms. Commission structures for Field Partners are governed by separate partner agreements.

6. Limitation of Liability

To the maximum extent permitted by law, Black Creek, LLC (operating as Bog & Bloom) shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products, plant death, or shipping delays.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
